Ben-Ari: 'Arabs Get a Pass, Hareidim and Settlers Get Arrested'

While the justice system enthusiastically prosecutes Hareidi Jews or “hilltop youth” from Judea and Samaria for being in the wrong place at the wrong time – specifically in an area where police are breaking up demonstrations and riots – the same doesn't apply to Arabs, in this case MK Hanin Zouabi and Arab religious leader Ra'ed Salah, says National Union MK Michael Ben-Ari. It isn't fair to let the two Arabs off for their participation in the 2010 Gaza flotilla, while youths who protest against the IDF's attempts to dismantle new communities – also known as “outposts” - are detained, and often prosecuted, even though they haven't actually done anything other than be in the way of police who are sent to break up the protests. And Ben-Ari, along with rightwing activist Itamar Ben-Gvir, demand that the two Arabs pay at least the same price as those youths do.
Specifically, Ben-Ari and Ben-Gvir are petitioning against a recent decision by Justice Minister Yehuda Weinstein not to prosecute Zouabi and Salah for participating in the flotilla last year. Weinstein last week closed the cases against the two, along with numerous other Israelis, because of what he termed “legal difficulties” in proving that they had violated Israeli law. The violations in question would include illegally entering Gaza – Weinstein said he could not prove that they had done so – and that those on the ships had acted against IDF soldiers.
The Ministry said in its decision that it did not intend this to set any precedents for the future, but Zouabi, for her part, said that she was not surprised at being exonerated – because she had not done anything wrong. “I argued all along that what I did was political, legal and legitimate. Participating in the flotilla was a moral imperative,” she said
But Ben-Ari and Ben-Gvir said that Zouabi's – and Weinstein's – positions were ridiculous. “There is a basic injustice in the Attorney General's position, and the state cannot afford to present such a stance, especially when it comes to terror and violence against IDF soldiers,” such as that that member of the flotilla committed against soldiers.
The petition states that Weinstein, by excusing participants of the flotilla, was actually acting in an undemocratic manner. Even if the Israeli participants did not raise a hand against IDF soldiers, the fact that they were participants in an event sponsored by a group Israel itself recognizes as a terrorist group – in this case the Turkish IHH – would be enough to prosecute the flotilla participants, for aiding and abetting terrorists. But as it happens, the petition says, the State has plenty of evidence linking participants to the actual events harming IDF troops.
“When it comes to Hareidim who were present at protests that turned violent,or residents of Judea and Samaria who participated in riots – even if they themselves did not do anything violent – police arrest them and they are put on trial. Apparently the law is different for Zouabi and Salah, and this is a great danger to the concept of equality before the law,” the petition adds.

Jewish, Not Arab, Roots in Judea and Samaria

U.S. Pres. Barack Obama’s demand that Israel not settle Jews in the Biblical areas of Judea and Samaria ignores thoroughly-documented Jewish roots in the Land of Israel, and in Judea/Samaria in particular.
Yoram Ettinger, a former liaison for Congressional affairs in Israel's Washington embassy, lists in the latest of his periodic position papers some of the evidence showing that Judea and Samaria has Jewish, not Arab, roots.
Area Always Known as "Judea and Samaria"
Ettinger negates Obama's claim – enunciated during his June 4, 2009 speech at Cairo University – that "the aspiration for a Jewish homeland is rooted in" the Holocaust. For one thing, Ettinger notes, many world-renowned travelers, historians and archeologists of earlier centuries refer to "Judea and Samaria," while the term "West Bank" was coined only 60 years ago.
Jordan gave the region this name when it occupied it after Israel’s War of Independence. No nation on earth other than Britain and Pakistan recognized Jordan’s claim to Judea and Samaria.
Among the travelers, historians and archeologists who referred to Judea and Samaria are H. B. Tristram (The Land of Israel, 1865); Mark Twain (Innocents Abroad, 1867); R.A. MacAlister and Masterman ("Palestine Exploration Fund Quarterly"); A.P. Stanley (Sinai and Palestine, 1887); E. Robinson and E. Smith (Biblical Researches in Palestine, 1841); C.W. Van de Velde (Peise durch Syrien und Paletsinea, 1861); and Felix Bovet (Voyage en Taire Sainte, 1864). Even the Encyclopedia Britannica, as well as official British and Ottoman records until 1950, used the term Judea and Samaria, and not the West Bank.
Land Was Named "Palestine" in Order to Erase Jewish Presence
Ettinger goes even further back, and says that the name "Palestine", which had nothing to do with a people as non by that name existed, was given to the Holy Land for the sole purpose of erasing the previous name of the country – Judea – from human memory. The Romans, whose plan this was, similarly sought to extinguish Jewish presence in Jerusalem by renaming it Aelia Capitolina.
Arabs Came in the Last 150 Years
When speaking of “Palestinian national rights,” it must be similarly kept in mind, Ettinger notes, that most Arabs residing today in Israel – anywhere between the Jordan River and the Mediterranean - have their origin in a massive 19th-20th century migration from Egypt, Syria, Lebanon and other Moslem countries. They adopted the title "Palestinian", which gives the impression of ancient ties to the land.
Town Names Betray Their True History
Finally, Ettinger says that almost all Arab localities in Judea and Samaria have retained Biblical Jewish names, thus reaffirming their Jewish roots. Examples include the following: Anata is Biblical (and contemporary) Anatot, the dwelling of the Prophet Jeremiah. Batir is Biblical (and contemporary) Beitar, the headquarters of Bar Kochba, the leader of the Great Rebellion against the Roman Empire, which was suppressed in 135CE. Beit-Hur is the biblical (and contemporary) Beit Horon, site of Judah the Maccabee's victory over the Assyrians. Beitin is biblical (and contemporary) Beit El, a site of the Holy Ark and Prophet Samuel's court. Bethlehem is mentioned 44 times in the Bible and is the birth place of King David. Beit Jalla is biblical (and contemporary) Gilo, in southern Jerusalem, where Sennacherib set his camp, while besieging Jerusalem. El-Jib is biblical (and contemporary) Gibeon, Joshua's battleground known for his command to stop the sun and moon (Joshua 10:12). Jaba' is the biblical (and contemporary) Geva, site of King Saul’s son Jonathan’s victory over the Philistines. Jenin is the biblical (and contemporary) Ein Ganim, a Levite town within the tribe of Issachar. Mukhmas is biblical (and contemporary) Mikhmash, residence of Jonathan the Maccabee and site of King Saul's fortress. Seilun is biblical (and contemporary) Shilo, a site of Joshua's tabernacle and the Holy Ark and Samuel's youth. Tequa is biblical (and contemporary) Tekoa, hometown of the Prophet Amos.
Arabs Never Wanted Palestinian State
In another of his posts, Ettinger has negated the US government position that a Palestinian state is the crux of the Arab-Israeli conflict and that its formation would resolve the situation. He cites proofs from recent history showing that Arab antipathy to Israel not only predates Palestinian concerns, but often sidesteps such interests.
Israel's war for its independence in 1948-9, for instance, was conducted by the Arab countries at the expense of local aspirations. Though Egypt conquered Gaza, and Jordan took Judea and Samaria, and Syria claimed the Golan, in none of these areas was a government of local Arabs allowed.
When Egypt conquered the Gaza Strip, it proceeded to prohibit "Palestinian" national activities and expel its leadership. Not only did Jordan not grant locals independence to Judea and Samaria, it actually annexed these areas to its own country. When Syria occupied and annexed the Hama area in the Golan Heights, the Arab League outlawed a provisional "Palestinian" government there.
In short, it can be concluded that Arab "rights" to a state in Judea and Samaria are historically weak and were long ignored by other Arab countries.

The United Nations and media suffer from “Obsessive Compulsive Israel Disorder (OCID),” says the British-born designer of the FreeMiddleEast.com, website which illustrates the anti-Israel agenda.
"Stop defending Israel and start showing the truth proactively", he tells Israel supporters. Knesset Member Yuli Edelstein published statistics Wednesday that show that 91 percent of Israelis feel that Israel has an extremely negative world image and is seen as an aggressive and unfriendly country.
Jonathan Bash now lives in Israel and was also co-founder of a media watchdog website. He says his aim is “to make the Middle East a free place” for everyone, including Christians whose rights have been eroded under the Palestinian Authority
The “FreeMiddleEast.com" website shows two chilling videos, brought below, one on the worldwide problem of refugees and the other on the international agenda to destroy Israel.
He feels that the fixation of the eyes of the world can be broken by repeated showing of what is happening to recent refugees in Darfur and other places. The Arab world and the United Nations have instead focused on the poor living conditions of Arabs left to languish in “refugee camps” for decades instead of being absorbed into their host country’s population, as is done with other refugees.

“Terrible things are going on in the world,” Bash told Israel National News, discussing his video on refugees. “It is a disaster and the world is not doing anything about it. The issue is not what’s going on in Israel. Over the last few years 300,000 people have been killed in Sudan,” he said and added that Google searches for Darfur are a mere four percent of those for Israel.
The second video presentation is called “The Phased Plan: The 3 step plan to destroy Israel”. It quotes a U.N.-hosted website of the Palestinian Authority observer at the United Nations as advocating an “armed struggle” and a “combatant national authority.” Bash’s notes these terms are “diametrically opposed to the U.N. charter. The charter’s opening paragraph mentions the word ‘peace’ five times”.
The video quotes former PA chairman Yasser Arafat’s 1996 statement,” Within five years, we plan to destroy Israel.” The film then shows the PA’s plan: “Acquire territory, use territory to launch terror, and destroy Israel.”

Security at heart of negotiations, he declares
WASHINGTON, Sept 21 – Israeli Prime Minister Benjamin Netanyahu is urging Palestinian President Mahmoud Abbas to recognize Israel as a Jewish state, saying that the lack of such recognition was at the heart of the Israeli-Palestinian conflict.
In a conference call with Jewish leaders Monday, Netanyahu said none of the obstacles standing in the way of a peace agreement was insurmountable.
“I believe that an agreement is possible. But to succeed, President Abbas and I have to be willing to stick it out even when we disagree,” he said. “We have to be willing to address the issues with an open mind. We have to be flexible and creative in finding compromises that are anchored in a realistic assessment of what is possible.”
Netanyahu said Israeli security was at the crux of the negotiations which resumed earlier this month after a 20-month hiatus. “We want peace, but it has to be a secure peace and it there have to be solid security arrangements on the ground to ensure the peace – for us and for our Palestinian neighbors, and maybe for the entire neighborhood,” he said.
He recalled that Israeli withdrawals from south Lebanon and Gaza were followed by a terrorist buildup by Iranian-backed Hezbollah and Hamas, both of which are heavily armed with tens of thousands of rockets and missiles capable of hitting Israeli population centers.
On the issue of recognition, Netanyahu said he acknowledged the Palestinian right to self-determination and sovereignty and it was time for Palestinians to do the same for the Jewish people and its homeland, the state of Israel.
“President Abbas has to decide. He cannot skirt the issue. He cannot find clever language designed to obfuscate or to fudge it.
“He needs to recognize the Jewish state. He needs to say it clearly and unequivocally. He needs to say it to his own people in their own language.
“Remember that famous commercial – Just Do It? I think for the Palestinian leadership, it’s even simpler: Just Say It. Say that you recognize Israel as the nation-state of the Jewish people. Say that you recognize the Jewish state,” Netanyahu declared.
